The Court of Santarém has pronounced Ivo Lucas, Cristina Branco, and Paulo Neves for trial in Sara Carreira’s death case.
The criminal investigation judge upheld Cristina Branco’s accusation of committing the crime of negligent homicide and withdrew the administrative offense for not placing the warning triangle.
The judge also aggravated the accusation imputed to Ivo Lucas, who will be tried for negligent homicide in gross form.
The same crime has been imputed to Paulo Neves, whose conduct contributed to the following accidents.
The judge withdrew the accusation of a serious administrative offense from Cristina Branco, as she prioritized her daughter’s safety and took refuge in the central separator.
The judge understood that the conduct of Cristina Branco and Ivo Lucas was a direct cause of the collision that followed.
Tiago Pacheco, the fourth involved in the accident, remains to be judged for a vehicle’s dangerous driving and two administrative offenses.
The instructional decision stressed that there is no evidence that he circulated below what appears in the indictment.
Cristina Branco tried to demonstrate in court that she took possible measures to signal the vehicle properly.
Ivo Lucas did not attend the court, but the Public Ministry considers him the main culprit in the accident.
